This document outlines how information that is collected from clients is used, who that information is shared with and how it is kept secure. This notice is not exhaustive. What a Nutritional Therapist Does
Nutritional Therapists provide nutritional therapy to clients to improve their health through diet and lifestyle interventions. There is a focus on preventative healthcare, the optimization of physical and mental health and chronic health conditions. Through naturopathic nutritional therapy consultations, dietary and lifestyle analysis and biochemical testing, the Nutritional Therapist aims to understand the underlying causes of your health issues which they will seek to address through personalized dietary therapy, nutraceutical prescription (supplements) and lifestyle advice.
1. How I obtain a client’s personal data
I offer online consultation services to clients residing all over the world in accordance with the standards set forth by the Personal Information Protection and Electronic Documents Act (PIPEDA), the Personal Health Information Protection Act (PHIPA), the Health Insurance Portability and Accountability Act (HIPAA) and General Data Protection Regulation (GDPR) to keep your privacy preserved and sessions confidential. I uses a video-call and practice management application that’s designed specifically for healthcare use. The video feature of the application is similar to Zoom, but its full-encryption and PIPEDA/PHIPA/HIPAA/GDPR-compliance keeps your privacy preserved and sessions (as well as all documents submitted on the platform) confidential.
I obtain a client’s information when they provide me with personal data in the following ways:
- By completing a nutritional therapy questionnaire
- By signing a terms of engagement form
- During a nutritional therapy consultation
- Through email or over the telephone
- This may include the following information:
– Basic details such as name, address, contact details and next of kin
– Details of contact I have had with you such as referrals and appointment requests
– Health information including your previous medical history, dietary, lifestyle, supplement and medicine details, biochemical test results, clinic notes and health improvement plans
– General Practitioner (GP) contact information
I use this information in order to provide you with direct healthcare. This means that the legal basis of my holding your personal data is for legitimate interest.
Following completion of your healthcare, I retain your personal data for the period defined by my professional association FNTP registrant body, GRCCT. This enables me to process any complaint you may make. In this case the legal basis of my holding your personal data is for contract administration.
Information I get from other sources
I may obtain sensitive medical information in the form of test results from biochemical testing companies (laboratories). I use this information in order to provide you with direct healthcare. This means that the legal basis of my holding your personal data is for legitimate interest.
I may obtain sensitive information from other healthcare providers. The provision of this information is subject to you giving us (myself and your other healthcare provider) your express consent. If I do not receive this consent from you, I will not be able to coordinate your healthcare with that provided by another provider (practitioner) which means that the healthcare provided by me may be less effective. Consent to discuss your case with another of your health care providers will always be asked for separately.
2. How I use a client’s personal data
I act as a data controller for use of your personal data to provide direct healthcare. I also act as a controller and processor in regard to the processing of your data from third parties such as testing companies/laboratories and other healthcare providers.
I undertake at all times to protect your personal data, including any health and contact details, in a manner which is consistent with my duty of professional confidence and the requirements of the General Data Protection Regulation (GDPR) concerning data protection. I will also take reasonable security measures to protect your personal data storage.
I may use your personal data where there is an overriding public interest in using the information e.g. in order to safeguard an individual, or to prevent a serious crime; in addition, where there is a legal requirement such as a formal court order.
3. Do you share a client’s information with other organizations?
I will keep information about you confidential. I will only disclose your information with other third parties with your express consent with the exception of the following categories of third parties:
- My registrant body, GRCCT, and my professional association, FNTP, for the processing of a complaint made by you
- Any contractors and advisors that provide a service to me or act as my agents on the understanding that they keep the information confidential
- Anyone to whom I may transfer my rights and duties under any agreement I have with you
- Any legal or crime prevention agencies and/or to satisfy any regulatory request (e.g. GRCCT) if I have a duty to do so or if the law allows me to do so
- I may share your information with supplement companies and biochemical testing companies as part of providing you with direct healthcare. I will not include any sensitive information
I will seek your express consent before sharing your information with your GP or other healthcare providers. However if I believe that your life is in danger then I may pass your information onto an appropriate authority (such as the police, social services in the case of a child or vulnerable adult, or GP in case of self-harm) using the legal basis of vital interests.
4. What are your rights as a client?
Every individual has the right to see, amend, delete or have a copy, of data held that can identify you, with some exceptions. You do not need to give a reason to see your data.
If you want to access your data you must make a subject access request in writing to me at office@onhealing.ca. Under special circumstances, some information may be withheld.
I shall respond within 30 working days from the point of receiving the request and all necessary information from you. My response will include the details of the personal data I hold on you including:
- Sources from which I acquired the information
- The purposes of processing the information
- Persons or entities with whom I have shared the information
You have the right, subject to exemptions, to ask to:
- Have your information deleted
- Have your information corrected or updated where it is no longer accurate
- Ask me to stop processing information about you where I am not required to do so by law or in accordance with the FNTP and GRCCT guidelines.
- Receive a copy of your personal data, which you have provided to me, in a structured, commonly used and machine readable format and have the right to transmit that data to another controller, without hindrance from me.
- Object at any time to the processing of personal data concerning you I do not carry out any automated processing, which may lead to automated decision based on your personal data. If you would like to invoke any of the above rights, please email me at office@onhealing.ca.
5. What safeguards are in place to ensure data that identifies me as a client is secure?
I only use information that may identify you in accordance with GDPR. This requires me to process personal data only if there is a legitimate basis for doing so and that any processing must be fair and lawful. Within the health sector, I also have to follow the common law duty of confidence, which means that where identifiable information about you has been given in confidence, it should be treated as confidential and only shared for the purpose of providing direct healthcare. I will protect your information, inform you of how your information will be used, and allow you to decide if and how your information can be shared. I also ensure the information I hold is kept in secure locations, restrict access to information to authorized personnel only, and protect personal and confidential information in locked filing cabinets in a locked, alarm protected office and forms that are filled out and signed electronically will be stored digitally on my password encrypted personal laptop. I ensure external data processors that support me are legally and contractually bound to operate and prove security arrangements are in place where data that could or does identify a person are processed.
6. How long do you hold confidential information about clients for?
All records held by me will be kept for the duration specified by guidance from my professional association (FNTP).

What are your rights? Depending on where you are located geographically, the applicable privacy law may mean you have certain rights regarding your personal information.
How do you exercise your rights? The easiest way to exercise your rights is by submitting a data subject access request, or by contacting us. WE will consider and act upon any request in accordance with applicable data protection laws.
1. What information do we collect?
Personal information you disclose to us
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or out products and Services, when you participate in activities on the Services, or otherwise when you contact us. We may collect information about you in a variety of ways. The information we may collect on the Site includes:
Personal Data
The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following: names, phone numbers, email addresses, mailing addresses, contact preferences, contact or authentication data, debit/credit cards, billing addresses, passwords, usernames, job titles, and demographic information that you voluntarily give to us when you choose to participate in various activities related to the Site, such as comment sections or purchasing products or services. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information: health data, financial data and genetic data. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site.
Payment Data
We may collect data necessary to process your payment if you choose to make purchase, such as your payment instrument number, and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information collected from other sources
In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and from other third parties. The information includes mailing addresses, job titles, email addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.
2. How do we process your information?
Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to
respond to your inquires and solve any potential issues you might have with the requested service - To enable user-to-user communications. We may process your information if you choose to use any of our offering that allow for communication with another user.
- To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
- To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to precent harm.
- To send you a newsletter.
3. What legal bases do we rely on to process your information?
If you are located in the EU or UK, this section applies to you.
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:
- Consent. We may process your information if you have given us permission (I.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time by emailing office@onhealing.ca.
- Performance of a Contract. We may process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
- Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to: Understand how our users use our products and services so we can improve user experience.
- Legal Obligations. We may process your information where we believe it is necessary for
compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved. - Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

We may process your information if you have given us specific permission (I.e., express
consent) to use your personal information for a specific purpose, or in situations where your
permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.
In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:
- If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
- For investigations and fraud detection and prevention
- For business transactions provided certain conditions are met
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with the next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
- If the collection is solely for journalistic, artistic, or literary purposes
- If the information is publicly available and is specified by the regulations
4. When and with whom do we share your personal information?
We may need to share your personal information in the following situations: Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
5. Do we use cookies and other tracking technologies?
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, present crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, or to tailor advertisements to your interests (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.
To extent these online tracking technologies are deemed to be a “sale”/“sharing” (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under the section “DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?”

6. How long do we keep your information?
We only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), when we will securely store your personal information and isolate it from any further processing until deletion is possible.
7. How do we keep your information safe?
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
8. Do we collect information from minors?
We do not knowingly collect, solicit data from, or market to children under 18 years of age, not do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 9. What are your privacy rights?
In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not the be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by email at office@onhealing.ca.
We will consider and act upon any request in accordance with applicable data protection laws.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.
If you are located in Switzerland, you many contact the Federal Data Protection and Information Commissioner.
Withdrawing your consent: If we are replying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent ay any time. You can withdraw your consent at any time by contacting us at office@onhealing.ca.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Opting out marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us at office@onhealing.ca. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and the use of your account, to respond to service requests, or for other non-marketing purposes.
Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services.

10. Controls for Do-Not-Track features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we not not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honouring DNT signals, we do not respond to them at this time.
11. Third-party websites and social networking services
The Site may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Site, any information you provide to these third parties is not covered by this Privacy Notice, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy notices or policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Site.
This Website may integrate with social networking services. You understand that we do not control such services and are not liable for the manner in which they operate. While we may provide you with the ability to use such services in connection with our Website, we are doing so merely as an accommodation and, like you, are relying upon those third-party services to operate properly and fairly.
You should be aware that information which you voluntarily include and transmit online in a publicly accessible blog, social network or otherwise online may be viewed and used by others. We are unable to control such uses of your information, and by using such services you assume the risk that the information provided by you may be viewed and used by third parties.

We only collect sensitive personal information, as defined by applicable privacy laws or the purposes allowed by law or with your consent. Sensitive personal information may be used, or disclosed to a service provider or contractor, for additional, specified purposed. You may have the right to limit the use or disclosure of your sensitive personal information for the purpose of inferring characteristics about you.
We may also collect other personal information outside of these categories through instances
where you interact with us in person, online, or by phone or mail in the context of:

We will use and retain the collected personal information as needed to provide the Services or for:

Will your information be shared with anyone else?
We may disclose your personal information with our service providers pursuant to a written
contract between us and each each service provider. Learn more about how we disclose
personal information to int he section, “When and with whom do we share your personal
information?”
We may use your personal information for our own business purposes, such as for undertaking
internal research for technological development and demonstration. This is not considered to be “selling” of your personal information.
We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.
Your Rights
- You have rights under US state data protection laws. However, these rights are not absolute,
and in certain cases, we may decline your request as permitted by law. These rights include: - Right to know whether or not we are processing your personal data
- Right to access your personal data
- Right to correct inaccuracies in your personal data
- Right to request the deletion of your personal data
- Right to obtain a copy of the personal data you previously shared with us
- Right to non-discrimination for exercising your rights
- Right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California’s privacy policy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects “” profiling”)
Depending upon the state where you live, you may also have the following rights:
- Right to obtain a list of the categories of third parties to which we have disclosed personal data (as permitted by applicable law, including California’s and Delaware’s privacy law)
- Right to obtain a list of specific third parties to which we have disclosed personal data (as permitted by applicable law, including Oregon’s privacy law)
- Right to limit use and disclose of sensitive personal data (as permitted by applicable law, including California’s privacy law)
- Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including
- Florida’s privacy law)
How to Exercise Your Rights
To exercise these rights you can contact us by submitting a data subject access request, by
emailing us at office@onhealing.ca.
Under certain US state data protection laws, you can designate an authorized agent to make a
request on your behalf. WE may deny a request from an authorized agent that does not submit
proof that they have been validly authorized to act on your behalf in accordance with applicable laws.
Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about when we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud prevention purposes.
If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.
Appeals
Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at office@onhealing.ca. We will inform you in wiring of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a compliant to your state attorney general.
California “Shine The Light” Law
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by emailing us at office@onhealing.ca.
